How mediation works

Your Phoenix divorce does not have to be a courtroom battle.

Mediation saves you money.

Your divorce mediation process stays private, moves at the pace the two of you set, costs a fixed amount you know in advance, and never sets you up as opponents.

1. Meet for your free 1-hour consultation

One hour, online, no charge and no commitment. Your mediator lays out the process end to end and answers any questions you have.

2. Reach your best agreements

A judge does not make the decisions. Your mediator brings up every issue that has to be decided, from parenting time to property division to spousal maintenance. Then they explain what Arizona law says and help the two of you reach an agreement you can both live with.

3. Finalize your consent decree

Everything you agreed to goes into a written consent decree, drafted by us and sent to you for review. If you want an independent attorney to read it before you sign, we can point you to options. Nothing is binding until it is signed and filed.

4. File your documents with Phoenix court

We connect you with our Arizona Certified Legal Document Preparer who submits your petition and consent decree to the Clerk of the Superior Court in Maricopa County. Nobody gets “served.” Neither of you sets foot in the courthouse. A judge reviews the paperwork and approves it.

Why do Phoenix spouses choose mediation instead of going to court?

Mediation is a private, cooperative process where a neutral third party helps you and your spouse settle everything, from property to parenting. Phoenix cases land in Maricopa County Superior Court, one of the largest trial court systems in the United States, and a contested case there means waiting your turn on a very full docket while the costs keep climbing. Spouses here choose mediation because it is quicker, quieter, and gentler, and because the terms come from the two people who know your situation and children best.

How long does mediation take for a Phoenix divorce?

Most Phoenix clients complete their process within two to four months. What moves that number is how complicated your finances are, whether children are involved, and what pace you both would like to take. Arizona's 60-day minimum waiting period is already built into that window. A contested case in Maricopa County courts can easily run past a year.

Where does a Phoenix divorce get filed?

With the Clerk of the Superior Court in Maricopa County. The Family Court File Counter sits inside the Central Court Building at 201 W. Jefferson Street, about half a mile west of our Van Buren Street office. Cases from the north and northeast sides of the city are often assigned instead to the Northeast Regional Center at 18380 N. 40th Street. When you mediate, our Arizona Certified Legal Document Preparer files everything on your behalf, and neither of you appears in a courtroom.

How does mediation handle complex assets for Phoenix households?

Phoenix is home to many industry-leading companies and a large public sector workforce. We routinely navigate Arizona State Retirement System (ASRS) benefits and balances, public safety pensions, and deferred compensation. Our team also manages home equity across Phoenix neighborhoods, from Arcadia to Deer Valley, along with small business interests, rental property, stock options, and investment portfolios. Your mediator helps you divide everything and reach clear agreements on spousal maintenance and child support, including amount and timeline.

What does custody mediation look like for a Phoenix family?

Parents produce a parenting plan that states who holds legal decision-making authority and how parenting time will be shared. Phoenix covers more than 500 square miles, so distance often requires detailed agreements in these plans. A Tuesday exchange between Ahwatukee and Deer Valley is a different conversation than one inside a compact city. Your mediator helps you build a customized schedule around your children's school calendar and attendance boundaries, whichever district they are in, along with actual commutes and practice schedules, all to meet the best interests of the child.

Does Arizona require a reason for the divorce?

No. Arizona is a no-fault state. To file in Phoenix you only have to say the marriage is irretrievably broken, and neither of you has to prove wrongdoing by the other. That matters more in mediation than people expect, because it takes blame off the table before you begin and frees both of you to spend the time focusing on what happens next rather than on the past.

Should I still talk to an attorney if we are mediating?

It is a good idea, and we encourage it. A mediator stays neutral and gives you legal information. They don't give either of you legal advice, which is exactly what makes the process work. An independent family law attorney who knows Maricopa County can give you specific legal advice and review the agreement before you sign it. If you want that review, we can point you to options. If not, that's okay too.

What does divorce mediation cost in Phoenix?

You get one all-inclusive flat fee, quoted during your free consultation for your specific situation, with payment plans available including interest-free options. No retainer. No hourly billing. No invoice that grows every time somebody sends an email. For contrast, Arizona attorneys generally open with a retainer somewhere between $5,000 and $15,000, and a litigated case averages north of $40,000. Mediation typically runs 80% to 90% below that, starting at $2,400 per person for your entire process.

Does online mediation actually work for Phoenix clients?

Yes. Online mediation works well, and it is how we run almost every meeting. Secure virtual access means you can join from your kitchen, from a downtown office between meetings, or from another state. Taking the drive out of an already challenging process is worth more than it sounds. The two of you can be in the same room or in two different ones, and everything said and shared stays confidential.

What happens once we reach an agreement?

Your mediator drafts a full Consent Decree of Dissolution covering every one of your agreements. It goes to Maricopa County Superior Court for a judge to review and sign. Once the judge signs, you are divorced. In nearly every case, neither of you will have walked into the courthouse at 201 W. Jefferson Street.

"Instead of making decisions on your behalf, your mediator acts as a bridge between you and your spouse to keep the conversation on track and moving forward."

The advantages of mediation

Mediation is the healthier way

A contested divorce in court can easily take over your life. It puts the two of you in opposition, and the strain shows up in your health, your work, and your household long before a judge ever rules on anything.

Our mediators help you have focused, creative, problem-solving conversations that get you to complete agreements. Less conflict means less damage for you and for everyone in your home.

Costs a fraction of a court case

Mediation generally runs 80% to 90% below the cost of litigation. Arizona attorneys typically open with a retainer of $5,000 to $15,000, and the average court case clears $40,000. We charge no retainer and we do not bill by the hour. You get one all-inclusive, predictable flat fee in your free consultation.

More about our pricing

Ends in months

You set the pace, and most of our clients are finished within 2 to 4 months. A litigated divorce in Arizona commonly runs 10 months to 2 years, sometimes longer. That is a year or more of your life spent inside a process designed to be adversarial.

Agreements that actually hold

People follow agreements they created. Spouses who finish through mediation stick to their decree at higher rates afterward, because the agreement was built around how their family actually works rather than handed down by a judge who met them for an hour.

Stays private

Arizona law protects what is said in mediation as private and confidential. Litigation is the opposite: filings, testimony, and financial disclosures become public record that anyone can pull. When personal details are on the table, that difference is worth a great deal.

You make the decisions

Mediation leaves the authority with the two of you. Your mediator explains workable options and guides you to your best possible agreement. Litigating means handing that authority to a judge who decides based on whatever limited picture two attorneys manage to present.

Conflict is what damages children, not the divorce itself

Child specialists are consistent on this point: sustained fighting during and after a separation can disrupt development and leave lasting emotional harm. Mediation puts your children first by keeping the conflict low and the adults talking. Our mediators work specifically on what kids need during a separation, and the parenting plan you leave with is one the two of you made together.

Protects your child's emotional health

Children whose parents cooperate through a separation come out of it more resilient, and their emotional development tends to stay on track. Ongoing conflict between parents is one of the strongest predictors of serious lasting emotional problems in kids after a separation.

Produces healthier co-parenting relationships

A low-conflict process and a written plan give parents a starting point for long-term, healthy co-parenting. The better the two of you adjust, the better your children adjust.

Enables better relationships with children

Parents who settle through mediation tend to hold onto deeper, steadier relationships with their kids over the years, because their kids never watched them spend a year as opponents.
